Fesl Lending Investor Corp, along with its subsidiaries, affiliates, and related entities engaged in business activities in the Philippines (referred to hereafter as the "Company"), highly regards the privacy of our Users and any individuals utilizing, accessing, downloading, browsing, or registering with the Services offered on the UtangOnline Loan website, its application, or other associated digital platforms or social media channels (referred to hereafter as the "Platform"). This Privacy Policy forms an integral part of UtangOnline Loan's commitment to honoring and safeguarding the personal data and information of every user of the Platform, including potential lenders or borrowers (referred to hereafter as "User", "you", or "Users"), as well as visitors to the Platform. The formulation of this Privacy Policy has been done in accordance with and in compliance with the laws of the Republic of the Philippines and is intended solely for the internal use of the Company. It outlines the policies of the Company, its subsidiaries, affiliates, and related entities concerning all types of Personal Data (as defined below) mentioned in this Privacy Policy, including sensitive personal information. In this Privacy Policy, "Personal Data" refers to any information, regardless of whether it is recorded in tangible form, from which the identity of an individual can be reasonably and directly determined by the entity holding the information, or when combined with other information, would directly and undoubtedly identify an individual, as defined under Republic Act No. 10173, commonly known as the Data Privacy Act of 2012 (hereafter referred to as the "Data Privacy Act"). Personal Data may be provided by individual users of the Platform, for the purpose of collection, use, and disclosure by the Company, its subsidiaries, affiliates, and related entities.

The scope of this Privacy Policy is limited to information collected or received by us through your use of the Platform. We are not accountable for the actions of third parties or companies, the content of their facilities, the utilization of the information you provide to them, the information they provide to you, or any products or services they may offer. Any link to those sites does not imply our partnership, sponsorship, endorsement, or affiliation with those parties, companies, or their brands.

1. Personal Information Collection

When you register for a UtangOnline Loan account or provide us with your personal information through the Platform, we may collect the following personal information: Name, Delivery Address, Email Address, Contact Number, Mobile Number, Date of Birth, Gender, employment details, banking and financial information, SMS data, location, and app list. This information may be used for risk management, fraud prevention, and to enhance the quality of our services to you.

We may also collect additional Personal Information with your explicit consent. For example, we may collect phone numbers from your contacts application for risk control purposes.

You are responsible for providing accurate and up-to-date information to us, our authorized agents, or the Platform. We reserve the right to request documentation to verify the information provided.

We can only collect your personal information if you voluntarily provide it to us. If you choose not to provide your personal information or withdraw your consent, we may not be able to provide our services to you. You can access and update your personal information at any time.

If you provide us with personal information about a third party, we assume that you have obtained their consent to share and transfer their personal information to us.

If you register for UtangOnline Loan using your social media account or link your UtangOnline Loan account to social media, we may access information voluntarily provided to us by your social media provider. We will handle this personal data in accordance with UtangOnline Loan's privacy policy and the provider's policies.

2. Use and Disclosure of Personal Information

The personal information collected from you may be used or shared with third parties, including related companies, third-party service providers, and third-party sellers, for some or all of the following purposes:

1) Facilitate your use of the Services (as defined in the Terms of Use) and/or access to the Platform.

2) Process orders submitted through the Platform, whether the products are sold by UtangOnline Loan or a third-party seller. Payments made through the Platform for products, whether sold by UtangOnline Loan or a third-party seller, will be processed by our agent.

3) Deliver the products you have purchased through the Platform, whether sold by UtangOnline Loan or a third-party seller. Personal information may be passed to a third party to facilitate product delivery to you, such as to our courier or supplier, regardless of whether the product is sold through the Platform by UtangOnline Loan or a third-party seller.

4) Provide updates on the delivery of products, whether sold through the Platform by UtangOnline Loan or a third-party seller, and for customer support purposes.

5) Compare information and verify with third parties to ensure accuracy of the information.

6) Additionally, we will utilize the information you provide to:

Administer your account (if any) with us. Verify and conduct financial transactions related to online payments. Audit data downloads from the Platform. Enhance the layout and/or content of Platform pages and tailor them for users. Identify visitors on the Platform. Conduct research on our users' demographics and behavior. Provide you with information we believe you may find useful or have requested, including details about our or third-party sellers' products and services, provided you have not objected to being contacted for these purposes.

7) Upon registering an account with UtangOnline Loan or providing us with your personal information through the Platform, we will also use your personal information to periodically send you marketing and/or promotional materials regarding our or third-party sellers' products and services. You can unsubscribe from receiving marketing information at any time using the unsubscribe function within the electronic marketing material. Additionally, we may use your contact information to send newsletters from us and our related companies.

8) In exceptional circumstances, UtangOnline Loan may be compelled to disclose personal information, such as when there are reasonable grounds to believe that disclosure is necessary to prevent a threat to life or health, or for law enforcement purposes, or to fulfill legal and regulatory requirements and requests.

9) SMS: During the loan application process, we need to collect your text messages, review and evaluate user loans, and ensure the safety of funds. SMS data will be encrypted and uploaded to our servers via the HTTPS protocol. We filter and delete personal text message data on our servers and only analyze financial-related text messages to identify risks. After the risk assessment, we will delete the relevant SMS data and never share this data with third parties.

10) Camera: We require camera access to provide you with an easy and smooth experience and enable you to take photos of your CNIC documents along with other required documents and upload them on the Platform during your loan application journey.

11) Mobile Phone(Device): To prevent fraud by ensuring that other phones cannot replace yours when requesting a loan, our app requires access to your device's International Mobile Equipment Identity (IMEI) number. The IMEI is a unique identifier assigned to each mobile device and is used to track and manage mobile devices on a cellular network.

12) Cancel Account and Delete Data: After paying off loan orders, you have the right to cancel your account. You can request account cancellation by clicking the "Me-Settings-Cancel Account" on the APP. Once you submit the cancellation, we will delete all relevant personal information under your account. After you log out, we will no longer provide you with loan products or services that require account login. We offer a cancellation application service within 7 days. For any inquiries, you can contact us anytime.

3. Disclose your personal data to third parties

We will only share your information with our registered third parties, including our regulated financial partners, for the provision of services on the Website and to facilitate a loan/facility for a User. Here's how we share your information:

1) We disclose and share your information with financial service providers, banks, as well as our third-party partners, to facilitate a loan, facility, line of credit, or purchase of a product.

2) Your information may be shared with our third-party partners for data analysis purposes to improve our services and products on the Website.

3) We may disclose your information without prior notice if required by law, government order, statutory authority, or to enforce our terms of use. This may also occur during corporate divestitures, mergers, or to protect the rights, property, or safety of us, our users, or others.

4) Data/information provided by a User may be shared with other technology partners to track user interactions with the Website on our behalf.

5) In the event of a merger, acquisition, reorganization, or restructuring of our business, we may share your information with another business entity. The receiving entity will be bound by this policy regarding your information.

6) We will disclose information to our third-party technology and credit partners to perform credit checks and analysis, such as Credit Bureaus or third-party data source providers.

7) Your information will be shared under a confidentiality agreement with third parties, restricting its use only for the purposes detailed herein. We ensure no unauthorized disclosure of your information shared with third parties.

8) By using the Platform, you consent to the Company sharing/disclosing your Personal Information with concerned third parties for Services and with governmental, quasi-governmental, judicial, and quasi-judicial authorities, as per applicable laws in the Philippines.

If we use or disclose your information for any purpose not specified above, we will obtain your explicit consent.

4. Withdrawal of Consent

You have the right to withdraw your consent to the continued use and/or disclosure of your personal information for any of the purposes and in the manner stated above at any time. However, please be aware that if you choose to object to our use and/or disclosure of your personal information as described above, depending on the nature of your objection, we may not be able to continue providing our products or services to you or fulfill any contracts we have with you.
